NMDS OÜ “No Refunds” Policy

 

  1. Scope of the Policy:

This “No Refunds” policy applies to all services provided by NMDS OÜ under the Nomads Embassy® brand, including but not limited to the Digital Nomad Visa Consultation and Done-For-You Digital Nomad Visa Application Service.

 

  1. Acknowledgement of Service Nature:

Clients acknowledge that the services provided by NMDS OÜ involve professional networking and facilitation of visa applications and do not include the issuance of visas or legal advice. The success of visa applications is subject to decisions made by respective government agencies and the legal advice and execution related to the visa application process are managed and conducted by our esteemed partners. By choosing NMDS OÜ, clients are acknowledging this division of roles where NMDS OÜ offers facilitation and networking support, while our partners provide the legal expertise and handle the execution of legal procedures related to the visa applications.

 

  1. No Refunds for Services Rendered:

Due to the nature of the services provided, once work has commenced on a client’s behalf – including initial consultations, professional networking, and visa application management – NMDS OÜ does not offer refunds. This policy reflects the time, effort, and resources expended in providing these services.

 

  1. Cancellation Prior to Service Commencement:

In the event that a client decides to cancel their engagement with NMDS OÜ before the commencement of any service activities, the following terms apply:

  • Notice of Cancellation: Clients are required to notify NMDS OÜ of their decision to cancel in writing. This notification should be sent to the designated contact email or address provided by NMDS OÜ.
  • Cancellation Fee: A cancellation fee will be applied to compensate for the preliminary preparations and administrative costs already incurred by NMDS OÜ. This fee is calculated as follows:
    • Within 24 hours of Engagement: No cancellation fee.
    • 24 to 48 hours after Engagement: A fee equivalent to 25% of the total service cost.
    • 48 hours or More after Engagement: A fee equivalent to 50% of the total service cost.
  • Refund of Pre-Paid Amounts: If the client has already made any payments towards the service, the refund amount will be the total payment made minus the applicable cancellation fee. The refund will be processed within 30 days of the cancellation notice.
  • Cancellation Acknowledgement: Upon receiving the cancellation notice, NMDS OÜ will acknowledge receipt and inform the client of the applicable cancellation fee and the process for the refund, if applicable.
  • Dispute Resolution: In case of any disputes regarding the cancellation fee, clients can reach out to our customer service for a resolution process, which will be handled in accordance with Estonian consumer protection laws.


By understanding and agreeing to these cancellation terms, clients can make informed decisions about their engagement with NMDS OÜ services. This policy is designed to be fair and transparent, respecting both the client’s right to cancel and NMDS OÜ’s need to manage its resources effectively.

 

  1. Exceptions to the Policy:

In exceptional circumstances, where it can be clearly demonstrated that NMDS OÜ has not fulfilled its contractual obligations or has provided services that are significantly deficient, a partial or full refund will be considered on a case-by-case basis.

 

  1. Compliance with Estonian Law:


This policy is in strict compliance with the consumer protection laws of Estonia, reflecting our commitment to providing personalized, bespoke services.

We respect the rights of consumers and are committed to operating within the legal framework provided by Estonian law.

 

  1. Acknowledgment and Agreement:

By purchasing services from NMDS OÜ (Nomads Embassy®), clients acknowledge and agree to this “No Refunds” policy. This policy forms a part of the terms and conditions agreed upon during the purchase of any service provided by NMDS OÜ.

NMDS OÜ, as a service-based company, operates under Estonian law which permits non-refundable policies for bespoke, personalized services that begin immediately upon agreement. Our services, which include personalized consultations, professional networking, and detailed preparation for visa applications, involve significant upfront efforts. These efforts require time, expertise, and resources that are irrevocably allocated once we start the service, making refunds financially impractical.

 

We recognize that applying for a digital nomad visa can be an emotional journey filled with anticipation and anxiety. Our team is dedicated to providing a tailored, empathetic service, fostering a bond of trust and understanding with our clients.

Issuing refunds for these custom and immediate services would not only diminish the value of the personalized expertise and effort already invested but also affect the trust and mutual commitment between NMDS OÜ and our clients. Therefore, despite understanding the uncertainties of visa applications, our no-refund policy is essential to maintain the sustainability and integrity of our high-quality, customized services.
